Are You a Victim of Discrimination in Louisville?

In the state of Kentucky, as well as across the nation, it is illegal to discriminate in the process of hiring, promoting, terminating, or any other employment-related action. Unfortunately, discrimination happens frequently in the workplace, leaving employees and their families suffering with the ruinous aftermath of injustice and unfair treatment.

Discrimination is illegal and can take on numerous forms, such as:

  • Age, race, color, national origin or heritage
  • Sex, gender, or sexual orientation
  • Religious affiliation
  • Disability
  • Pregnancy
  • Retaliation and whistleblower claims
  • Housing

If you think you have been discriminated against by an employer, coworker, government, agency, union, or any other entity within your workplace, you must speak with our Louisville employment attorneys. At Biesecker Dutkanych & Macer, LLC, we know how to advocate for the fullest protection of your rights after your civil and Constitutional liberties have been egregiously violated.

We Are Devoted to Preventing Discrimination

Do you think you have a claim involving workplace discrimination? To move forward in your claim, speak with our legal team today. • Civil Rights Act of 1964
  • Americans with Disabilities Act (ADA)
  • Age Discrimination in Employment Act (ADEA)
  • Genetic Information Nondiscrimination Act (GINA)

Though it may be scary taking legal action against an employer or former employer, we encourage you to take a step towards seeking justice today. We at Biesecker Dutkanych & Macer, LLC strive to make the workplace a more transparent, safer, and fairer environment. We aim to root out all instances of injustice. By taking the much needed step, you could be making the statement that is needed to put a stop to workplace discrimination in your company, as well as other companies within the community.

Disability Discrimination

Title I of the Americans with Disabilities Act of 1990 prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and other terms, conditions, and privileges of employment.

In addition, an employer is required to make a reasonable accommodation to the known disability of a qualified applicant or employee if it would not impose an "undue hardship" on the operation of the employer's business. If you feel that you have been treated differently based on your disability or your employer has refused to accommodate your disability, contact one of our Indianapolis, Evansville or Louisville attorneys today.

Gender Discrimination

The Kentucky Civil Rights Act makes it unlawful for an employer to discriminate against a certain employee based on their gender, race, color, religion, national origin or age—especially when it comes to wages. More specifically, KY Rev. Stat. Sec. 344.100 states that an employer could only apply different standards of compensation if it is based on a bona fide seniority or merit system. This means that men and women must be paid equally if they hold the same positions.

Examples of gender discrimination in the workplace include:

  • Refusing to hire or promote someone based on their gender
  • Paying a male employee more than a female for the same position
  • Refusing to hire or promote a woman because she is pregnant
  • Refusing to hire a woman because she intends to become pregnant
  • Making unfounded assumptions based on an employee’s gender

By law, men and women are entitled to equal pay if they perform the same jobs in the same company. This not only refers to salary, but also bonuses, benefits, overtime pay and stock options. If you are being paid less than a coworker of the opposite sex even though you have been asked to perform the same duties, you may have a claim for gender discrimination.
